End User License Agreement

Parties and Application

This Agreement is between you (the "End User") and Thee Clod Apps ("Licensor") regarding your use of the AI Citizenship Quiz application, including both the iOS mobile application and web application (collectively, the "Application").

If you are using the Application on an Apple-branded product, Apple Inc. is a third-party beneficiary of this Agreement and has the right to enforce this Agreement against you.

License Grant

Subject to your compliance with this Agreement, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the Application on devices you own or control
• Access and use the Application for personal, non-commercial purposes
• Use the Application to prepare for the U.S. Citizenship civics test

Restrictions: You may not:

• Copy, modify, or create derivative works of the Application
• Reverse engineer, decompile, or disassemble the Application
• Rent, lease, lend, sell, redistribute, or sublicense the Application
• Remove any proprietary notices or labels from the Application
• Use the Application for any unlawful purpose
• Share your account credentials with others

Subscription and Payment Terms

The Application offers both free and premium (paid) subscription tiers:

Free Tier

• Access to quiz questions with daily question limits
• Basic quiz functionality

Premium Subscription

• Unlimited quiz questions
• Full access to all features
• Billed weekly at $0.99 USD
• Automatically renews unless canceled

Payment Processing

All payments are processed securely through Stripe. By subscribing, you agree to Stripe's terms of service and privacy policy.

Cancellation and Refunds

• You may cancel your subscription at any time from the "You" tab in the Application
• Upon cancellation, you retain premium access until the end of your current billing period
• No refunds are provided for partial billing periods
• Subscriptions are non-transferable

Content and Intellectual Property

All content within the Application, including but not limited to text, graphics, logos, quiz questions, AI-generated feedback, and software, is the property of Licensor or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

Quiz Content

• Quiz questions are based on official USCIS civics test materials
• AI-generated feedback is provided for educational purposes only
• Content accuracy is not guaranteed; official USCIS materials should be consulted for authoritative information

User-Generated Content

You retain ownership of your quiz responses and progress data. By using the Application, you grant Licensor a license to use this data solely for the purpose of providing the Application's features and improving the service.

Privacy and Data Collection

Your use of the Application is subject to our Privacy Policy, available at https://www.theeclodapps.com/privacy.html. By using the Application, you consent to the collection and use of your information as described in the Privacy Policy.

Age Restrictions and Content Warning

The Application is rated 17+ due to mature content in the comedy mode feature, which includes profanity and dark humor. By using the Application, you confirm that you are at least 17 years of age or the age of majority in your jurisdiction, whichever is greater.

Account Deletion

You may delete your account at any time from the "You" tab in the Application. Upon account deletion:

• Your personal data will be permanently deleted within 30 days
• Active subscriptions will be immediately canceled
• No refunds will be provided for unused subscription time
• Transaction records may be retained by our payment processor (Stripe) for financial and legal compliance
• This action cannot be undone

Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding accuracy, reliability, or completeness of quiz content
• Warranties that the Application will be uninterrupted, timely, secure, or error-free
• Warranties regarding the results obtained from using the Application

Educational Disclaimer: The Application is designed as a study aid for the U.S. Citizenship test. It does not guarantee passing scores on the actual civics test. Official USCIS materials should be consulted for authoritative information.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• LICENSOR'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID TO LICENSOR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you. In such jurisdictions, Licensor's liability will be limited to the greatest extent permitted by law.

Third-Party Services

The Application integrates with third-party services including:

• Google Sign-In (authentication)
• Apple Sign In (authentication)
• Stripe (payment processing)
• Anthropic Claude API (AI-powered feedback)
• Supabase (data storage)

Your use of these services is subject to their respective terms of service and privacy policies. Licensor is not responsible for the practices of these third-party services.

Apple-Specific Terms

If you are using the Application on an Apple-branded product:

• This Agreement is between you and Licensor, not Apple
• Apple has no obligation to furnish maintenance and support services
• Apple is not responsible for addressing any claims relating to the Application or your possession and use of the Application
• Apple is not responsible for any product liability claims, claims that the Application fails to conform to legal or regulatory requirements, or claims under consumer protection or similar legislation
• In the event of any third-party claim that the Application infringes that third party's intellectual property rights, Licensor, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim
• Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement and have the right to enforce this Agreement against you

Updates and Modifications

Licensor may update the Application from time to time to add new features, fix bugs, or improve performance. You agree that updates may be automatically downloaded and installed. Licensor may also modify this Agreement at any time by posting the updated terms. Your continued use of the Application after such modifications constitutes acceptance of the updated Agreement.

Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination:

• You must cease all use of the Application
• You must delete all copies of the Application from your devices
• Licensor may delete your account and all associated data
• Sections 4 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), and 15 (Governing Law) will survive termination

Export Compliance

You may not use or export the Application except as authorized by United States law and the laws of the jurisdiction in which the Application was obtained. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.

Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that:

• Either party may seek injunctive or other equitable relief in any court of competent jurisdiction
• Disputes may be brought in small claims court if they qualify
• If you are located in the European Union or European Economic Area, you have the right to resolve disputes under the laws and in the courts of your country of residence

Severability

If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable.

Entire Agreement

This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and Licensor regarding the Application and supersedes all prior agreements and understandings, whether written or oral, regarding the subject matter.

By using the Application, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions.
